USCRI’s legal program stands for unlawfully detained individuals at the US-MX border in Tijuana

Our legal team at the U.S.-Mexican border (USMBP) fights to protect the rights of migrants every day. Oftentimes, the USMBP is the only legal actor offering specialized representation, making us an essential presence on the frontier. For example, take a recent client from Iraq, who shall remain anonymous. This individual accidentally entered Mexican territory through the border crossing between San Diego and Tijuana and was then unjustly detained by authorities. These authorities violated Mexican law by detaining our client for a longer period of time than is legally permissible and neglecting to inform him of his rights during his time under their care.

In response to this grave injustice, our legal team filed an amparo lawsuit and won. However, despite the judge ordering our client’s immediate release, the responsible government body would not comply. Not only did they keep this individual detained, but they also did not allow him to access his file or information about his legal situation. But the USMBP team did not give up their fight; they filed various legal remedies to inform the judge of the government authority’s noncompliance. Once again, their efforts were not in vain. Our client finally regained freedom on Thursday, June 12, when he was released from the detention center.
